1. About These Terms
These Terms of Service ("Terms") form a legally binding agreement between you and Dose Deck ("we", "us", "our"), a company registered in England and Wales, regarding your use of the Dose Deck iOS application and any related services (together, "the App").
By creating an account or using the App, you confirm that you have read, understood, and agree to these Terms. If you do not agree, do not use the App.
We may update these Terms from time to time. If we make material changes, we will notify you through the App or by email before the changes take effect. Continued use of the App after that point constitutes acceptance of the revised Terms.
2. Eligibility
You must be at least 16 years old to use Dose Deck. By using the App, you confirm that you meet this requirement.
If you are using Dose Deck on behalf of a person who cannot manage their own account (for example, a child or a person in your care), you confirm that you have the authority to accept these Terms on their behalf and that you take responsibility for their use of the App.
3. Your Account
3.1 Registration
To use Dose Deck you must create an account using a valid email address and password, or via Sign in with Apple. You agree to provide accurate information and to keep it up to date.
3.2 Account security
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at support@dosedeck.uk if you believe your account has been compromised.
We are not liable for any loss or damage arising from unauthorised access to your account where you have failed to keep your credentials secure.
3.3 One account per person
Accounts are personal and may not be transferred to or shared with another person.
4. Subscription and Payment
4.1 Free and paid features
Dose Deck offers both free features and premium features available under a paid subscription. The specific features included in each tier are described within the App and may be updated from time to time.
4.2 Free trial
If you are eligible, you may be offered a free trial period before your subscription begins. At the end of the free trial, your subscription will automatically begin and you will be charged unless you cancel before the trial expires.
4.3 Billing
All subscriptions are billed through Apple's App Store using In-App Purchase. By subscribing, you also agree to Apple's terms and conditions for In-App Purchases, available at https://www.apple.com/legal/internet-services/itunes/. Payment is charged to your Apple ID account at confirmation of purchase.
We do not process or store any payment card information directly.
4.4 Renewal
Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. Your Apple ID account will be charged within 24 hours of the renewal date.
4.5 Cancellation
You may cancel your subscription at any time through your Apple ID account settings (Settings → [Your Name] → Subscriptions). Cancellation takes effect at the end of the current billing period. You will retain access to premium features until that date. We do not offer refunds for partial billing periods.
4.6 Caregiver accounts
Caregiver roles do not require a paid subscription. Patient (dependant) accounts require an active subscription to access premium features. If a patient's subscription lapses, the caregiver's ability to view and manage that patient's data may be limited.
4.7 Pricing changes
We reserve the right to change subscription prices. If we change the price of your subscription, we will notify you in advance through the App or by email. Continued use of the App after the change takes effect constitutes your acceptance of the new price.
5. Acceptable Use
You agree to use Dose Deck only for lawful purposes and in accordance with these Terms. You must not:
- Use the App in any way that violates applicable laws or regulations
- Use the App to store or transmit data on behalf of another person without their knowledge and consent
- Attempt to gain unauthorised access to any part of the App, our infrastructure, or the accounts of other users
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App
- Use the App to transmit any malware, viruses, or other harmful code
- Reproduce, redistribute, sell, or sub-licence the App or any part of it
- Scrape, mine, or systematically extract data from the App
- Use the App in any way that could damage, overburden, or impair our systems or interfere with other users' use of the App
- Misrepresent your identity or impersonate any other person
We reserve the right to suspend or terminate your account if we reasonably believe you have breached these restrictions.
6. Medical Disclaimer
Dose Deck is not a medical device and is not intended to replace professional medical advice, diagnosis, or treatment.
The App is a tool to help you record and track medication schedules and adherence. It does not:
- Provide medical advice of any kind
- Verify that a medication, dose, or schedule entered by a user is safe or appropriate
- Detect interactions between medications
- Issue clinical recommendations
- Replace communication with your doctor, pharmacist, or other healthcare professional
You are solely responsible for the accuracy of the information you enter into the App. Always follow the instructions of your prescribing clinician. Never start, stop, or change a medication based on information in this App without first consulting a qualified healthcare professional.
Missed dose reminders and adherence statistics are informational only. We accept no responsibility for any harm, injury, or adverse outcome arising from a missed dose, an incorrectly logged dose, or any action taken or not taken in reliance on information displayed in the App.
If you experience a medical emergency, call the emergency services immediately. Do not rely on this App in an emergency.
7. Caregiver Relationships
7.1 Linking
Dose Deck allows patients to grant caregivers access to view and, where permitted, manage their medication data. A care link is established only when both parties have consented through the App's invite and acceptance flow.
7.2 Responsibilities
If you use Dose Deck as a caregiver:
- You confirm that you have the patient's informed consent to access their data
- You agree to use the patient's data only for the purpose of supporting their care
- You are responsible for maintaining the confidentiality of any patient data you access
- You must not share patient data with third parties without the patient's consent
If you are a patient:
- You are responsible for only linking with caregivers you trust
- You may revoke caregiver access at any time through the App's Settings
7.3 No clinical relationship
Dose Deck does not create, facilitate, or evidence any clinical or professional relationship between a caregiver and a patient. Any responsibilities arising from a caring relationship exist independently of the App.
8. Intellectual Property
The App, including its design, code, content, trademarks, and all other materials, is owned by Dose Deck and is protected by copyright and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App on your personal iOS device strictly in accordance with these Terms. This licence does not include any right to copy, modify, distribute, or create derivative works from the App.
Any feedback, suggestions, or ideas you provide to us about the App may be used by us without restriction or compensation to you.
9. User Content
You retain ownership of the data you enter into Dose Deck (your medications, dose logs, notes, and other content). By using the App, you grant us a limited licence to store and process that data solely to provide the service to you, as described in our Privacy Policy.
You are responsible for the accuracy of the data you enter. We do not review user-entered data and make no representations about its accuracy or completeness.
10. Availability and Changes to the App
We aim to keep Dose Deck available and functioning, but we do not guarantee uninterrupted or error-free access. The App may be unavailable due to maintenance, updates, or circumstances beyond our control.
We reserve the right to modify, suspend, or discontinue any part of the App at any time with reasonable notice where practicable. We will not be liable to you for any modification, suspension, or discontinuation of the App.
If we discontinue the App entirely, we will provide reasonable notice and, where technically feasible, provide a means for you to export your data beforehand.
11. Disclaimer of Warranties
To the maximum extent permitted by law, the App is provided "as is" and "as available" without any warranties of any kind, whether express or implied, including but not limited to:
- Fitness for a particular purpose
- Accuracy or completeness of any information displayed
- Uninterrupted or error-free operation
- Freedom from viruses or harmful components
Nothing in these Terms affects your statutory rights as a consumer under UK law, which cannot be excluded.
12. Limitation of Liability
To the maximum extent permitted by applicable law, SHM Capital LTD shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages
- Any loss of data, loss of revenue, or loss of profits
- Any harm arising from your reliance on the App for medical purposes
- Any harm arising from a missed, delayed, or incorrect medication dose
- Any interruption or unavailability of the App
Our total aggregate liability to you for any claim arising from your use of the App shall not exceed the amount you paid for your subscription in the 12 months preceding the claim, or £50, whichever is greater.
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be limited by law.
13. Indemnity
You agree to indemnify and hold harmless Dose Deck, its officers, employees, and agents from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising from:
- Your breach of these Terms
- Your use of the App in a manner not permitted by these Terms
- Any data you enter into the App
- Your breach of any applicable law
14. Third-Party Services
The App uses third-party services to function, including:
- Supabase — cloud database and authentication (EU West — Ireland). Supabase's terms of service and privacy policy apply to its processing of your data.
- Apple App Store / StoreKit — subscription management. Apple's terms apply to all In-App Purchases.
- Apple Sign in — optional authentication method. Apple's terms apply.
We are not responsible for the availability or conduct of any third-party service. Links to third-party services are provided for convenience only.
15. Termination
15.1 By you
You may close your account at any time from within the App (Settings → Account → Delete Account) or by contacting us at support@dosedeck.uk. Deleting your account will initiate a 30-day grace period, after which your data is permanently deleted in accordance with our Privacy Policy. Any active subscription must be cancelled separately through your Apple ID account settings.
15.2 By us
We may suspend or terminate your account immediately if:
- You breach these Terms in a serious or repeated manner
- We are required to do so by law
- We reasonably believe continued access poses a risk to other users or our systems
Where possible, we will notify you before taking action and give you an opportunity to remedy the breach.
15.3 Effect of termination
On termination, your licence to use the App ends immediately. Provisions of these Terms that by their nature should survive termination (including the medical disclaimer, limitation of liability, and intellectual property sections) will continue to apply.
16. Governing Law and Disputes
These Terms are governed by the laws of England and Wales. Any dispute arising from or in connection with these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of England and Wales.
If you are a consumer resident in another jurisdiction, you may also have rights under the law of your country of residence that cannot be overridden by a choice of law clause.
We encourage you to contact us at support@dosedeck.uk in the first instance to resolve any dispute informally before pursuing formal legal action.
17. General
- Entire agreement — These Terms, together with our Privacy Policy, constitute the entire agreement between you and Dose Deck regarding the App.
- Severability — If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force and effect.
- No waiver — Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce it in the future.
- Assignment — We may assign our rights and obligations under these Terms to another entity in connection with a merger, acquisition, or sale of assets. You may not assign your rights under these Terms without our prior written consent.
